The customer grants permission to ListingEFlyer to send the flyer that they have created and saved on our server to their fellow agents in the marketing area that they have purchased. Furthermore if you have purchased our listing Ad Bundle you grant us permission to post your listing to the advertising sites that we work with; we will do everything we can to post your site for as long as possible on all the classified sites but due to conditions out of our control your flyer may not show on all the sites. Furthermore it will take 24-48hrs for your listing to show on all the sites.

It is the customer’s responsibility to make sure that all of the contents uploaded in their flyer are accurate; including spelling, price information, address and their announcement. However ListingEFlyer will do everything in their control to help and resolve the problem before the flyer has been sent. Customers are required to approve each flyer once they have created the flyer.

It is your responsibility to abide to all of your member board rules, association rules, fair housing policy and state policy. It is also your responsibility to abide by your state's electronic mail policy; we are compliant by the US CAN-Spam Law.

It is agreed between you and ListingEFlyer.com that if you do not wish to receive flyers from us that you will not view our flyers and opt-out the very first time that you preview our flyer.
It is also agreed that if you register on our site that you will be input in our database. By registering on our website you agree to receive marketing materials from us as well as our customers on a consistant basis. You will always have the option to opt-out through our website by clicking on the link that appears on all of our emails or calling us at 1-800-435-5144 as well as the option to sending us and email to abuse@listingeflyer.com to be removed from our system.

You are only to send property flyers or real estate related flyers. (Real estate related flyers have to be pre-approved by email/phone before) If you order a flyer without approval and it is not real estate related you will be charged a 200$ non-refundable penalty. Please call us BEFORE you send out a flyer that is not a service/property for real estate agents.

ListingEFlyer does not guarantee that every single agent in a specific region will receive the flyer. Due to spam filters, secure servers, server push-backs, image blockers many agents will NOT receive your eflyer. The same rule applies for all of our competitors. The major ISP's block bulk emails and push back before it even gets through. Click HERE to read further about this issue. Also if you are doing a custom flyer your flyer's deliverability will be reduced because many receiving servers will block your flyer since it is not optimized to bypass their filters. Most likely Comcast and AOL users will not receive your custom flyer due to it being blocked. Any real estate agent can send us an email address with their full contact information and we can then add them to our database. Any agent that has just joined the real estate industry is also not in our databse.

Refunds: Once you have approved and paid for your flyer your flyer will be sent on the appproved delivery date and no refund will be provided. If you have any question about anything feel free to contact us before paying for the flyer.

It is the customer’s responsibility to make sure the image that they are uploading on our server is not copyrighted and that they have permission to use the image in their marketing materials.

Spam Compliance

We do not sell, distribute or share any of your information to 3rd party companies.

All the flyers from us clearly states at the bottom of each flyer that the flyer is a business communication from a real estate agent or a developer to a real estate agent or a developor. Our opt-out link is located at the bottom of every emails and you can also reply, call us or write us to be removed. Removal requests are honored immediately

after receiving the request. Our mailing address is located at the bottom of all of our emails. Our subject lines are descriptive of the content, not deceptive and not misleading. We do not sell, distribute or share any information with any 3rd party for customers who order our services or request for removal. You can only use our site if you are a licensed realtor, developor or a builder.

Liability Limit: It is agreed that the entire remedy for the breach of this agreement shall be limited to the specific price paid for the order and will not include or extend to any claim for or right to recover any other damages, including but not limited to loss of profit, or special, incidental or consequential damages or other similar claims. In no event will ListingEFlyer.com’s liability for any damages to you or any other person ever exceed the actual price paid for the products purchased on your order.

Furthermore in the event of a lawsuit you agree that state of Washington's jursdiction will be the one for the case.

ListingEFlyer’s website and associated services may only be used for lawful purposes. Unlawful purposes will not be tolerated.
